Kapan Ya? — Terms Of Use

By using, downloading, or installing the "Kapan Ya?" app or web-app (hereby referred to as "Application"), you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

We are dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, we reserve the right to modify the Application or charge for our services at any time and for any reason. We assure you that any charges for the Application or its services will be clearly communicated to you.

The Application offers two method of use, offline-only & offline-first with encrypted cloud syncing. If you use the latter, we will need to store and process your personal data in order to provide the Service. (See privacy policy for more details.)

You are responsible for the content you save while using the Application. It is your responsibility to maintain the security of your phone and access to the Application. We strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.

The Application may offer in-app purchases that provide additional features or benefits. These purchases are non-refundable and cannot be transferred to another account.

If you choose to delete your account, all associated data, including your in-app purchases, will be permanently deleted and cannot be restored. By deleting your account, you acknowledge and accept that you will lose access to your purchases without the ability to restore them.

Please note that the Application utilizes third-party services that have their own Terms of Use. Below are the links to the Terms of Use of the third-party service providers used by the Application:

In terms of our responsibility for your use of the Application, it is important to note that while we strive to ensure that it is updated and accurate at all times, we do rely on third parties to provide information to us so that we can make it available to you. We accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the Application.

The Application may revoke or suspend your access to it at any time, either with or without justification, and without prior notification. Upon termination, all rights and licenses granted to you under these Terms will immediately expire, requiring you to stop using the Application.

The Application is provided "as is" and without warranties of any kind, whether express or implied. We do not warrant that the Application will be uninterrupted, or error-free.

We may wish to update the Application at some point. The Application is currently available as per the requirements for the operating system (and for any additional systems we decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the Application.

We do not guarantee that we will always update the Application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the Application when offered to you. We may also wish to cease providing the Application and may terminate its use at any time without providing termination notice to you. Upon any termination, (a) the rights granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.
